Successful Judgment in Complex Easement Case

Major Connecticut Developer

Represented a major Connecticut developer seeking to enforce a 40-year old easement to support the development of his $10 million property. The owner of the servient estate claimed that the easement was invalid, and/or did not permit our client to run utilities through the easement. The case involved complex aspects of real estate and easement law, many of which had not previously been addressed by Connecticut courts. After a 2-day trial and extensive briefing, the trial court entered judgment in our client’s favor. Hyde Road Development v. Pumpkin Associates, New Britain Superior Court, May 26, 2010. We are now representing the client on appeal.
