Dan Schwartz recently provided commentary for the Bloomberg BNA Electronic Commerce & Law Report about the growing trend of employers adopting digital hiring platforms. The piece focuses on issues that may arise for employers adapting this technique becoming susceptible to the possibility of discrimination based on age or disability of the applicants.
While companies offering this software feature intended neutrality, Dan points out that, ‘‘Employers may be trying to remove bias from their decision-making process, but they must be aware that these games have limitations on their use.’’ To comply with the American Disability Association (ADA) Dan suggests, “Employers need to ensure that the visually-impaired and other disabled individuals have the opportunity to request an accommodation or alternative to the technology being used.” He further adds, “and the results of an alternative screening method must be sufficiently similar to that of the technology.”
