Petroleum Marketing

Shipman & Goodwin is perhaps the leading firm in the Northeast in representing petroleum marketers. For over 20 years we have represented major oil companies and regionally-based franchisors in New England, New York and New Jersey in all aspects of petroleum marketing-related counseling and litigation, under both the Petroleum Marketing Practices Act ("PMPA") and state franchise statutes. We have extensive experience in litigation involving dealer terminations under the PMPA, both in defending terminations and affirmatively seeking declaratory relief to enforce termination and obtain prompt possession of the premises. We also regularly represent franchisors in complex multi-dealer litigation and in lawsuits involving claims related to pricing, rent, assignment and other franchise related issues.

We have litigated cases in state and federal trial courts in New England, New York and New Jersey, and in the First and Second Circuit Courts of Appeal. Our members include a past Chair of the Franchise Section of the Connecticut Bar Association, and a speaker at the annual Petroleum Marketing Attorneys meeting.
