Health Care Immigration Compliance and Enforcement Task Force

Shipman & Goodwin’s Immigration Compliance and Enforcement Task Force has extensive experience advising private and public health care providers including hospitals, individual physicians, physician practices, nurses, researchers and long-term care providers on employment-based immigration issues.  We have obtained Conrad Amendment waivers of the two-year foreign residency requirement for foreign national physicians with J-1 visas, as well as H-1B and O-l nonimmigrant visas for such physicians and researchers.  Our Task Force has also successfully obtained H-lB cap exemptions for non-profit hospitals affiliated with institutions of higher education and nonprofit research organizations.  We handle permanent labor certifications and national interest waivers for physicians, obtaining first and second- employment-based immigrant visas preferences where appropriate for physicians.  We assist our clients in obtaining H-lB and TN visas nonimmigrant visas, as well as second and third employment-based green cards, for foreign national nurses. 

Our Task Force also attends to the immigration needs of the healthcare worker’s accompanying spouse and children.  Additionally, after assisting our health care clients in obtaining their green cards, we represent them and their family members in obtaining U.S. citizenship.  We help our clients plan ahead in order to navigate successfully the complex immigration laws pertaining to the increasingly diverse healthcare industry. 

We also support our clients in developing and implementing internal policies and best practices to control organizational legal risk related to immigration law.  We educate our clients regarding sanctions, recordkeeping, and documentation obligations related to immigration laws, including the proper completion of I-9 forms, as well as assisting them in their internal audit initiatives and correction of deficiencies.  If the need arises, the Task Force also represents our health care clients in litigation or proceedings involving immigration law issues and work with both government agencies and federal prosecutors to resolve such issues in a timely manner.
