Oil Spill Response, Natural Resource Damage Assessment and Litigation Support

Barge Company and its Insurer

Represent a barge company and its insurer with respect to a significant 2003 oil spill off the New England coast.  Engaged and directed the responsible party’s technical team (multiple vendors) in oversight of federal response and follow on investigation/cleanup of more than 100 miles of diverse shoreline types in Massachusetts and Rhode Island, including under the Massachusetts Contingency Plan.  Negotiated Memorandum of Understanding and Consent Decree and coordinated extensive natural resource damage assessment and restoration planning with State and Federal Trustees (NOAA, DOI/USFWS, MA, and RI) involving: lost shoreline, boating and recreational shell-fishing use, and injuries to birds/wildlife (including threatened and endangered species) and aquatic and shoreline resources.  Provided scientific/environmental support in connection with third-party claims (including those of a federally-recognized Indian tribe) and related criminal and civil proceedings (including two class actions).
