The Shipman construction team was called in to assist a local municipality, when, shortly after substantial completion of a municipal development along the Connecticut River, it became apparent that a portion of the developed site was sliding down the riverbank toward the river. We successfully brokered a settlement among our client and various design professionals responsible for the design of the project.

In addition to our key role in the settlement, we also successfully negotiated contracts between the municipality and new, as well as existing, design professionals for completion of remedial work required to stabilize the site. These contracts were particularly complicated due to the potentially overlapping responsibilities and liabilities of the design professionals brought in for the remedial work and the original design professionals for the project.
