The Equal Employment Opportunity Commission (EEOC) has recently shifted its enforcement priorities away from several issues emphasized by previous administrations. One notable exception, however, is the Pregnant Workers Fairness Act (PWFA), a Biden-era law that remains an enforcement focus under the current administration.

That said, the EEOC appears to be taking a narrower approach to interpreting the law under its current leadership.

Shipman partner Daniel Schwartz was recently quoted in HR Brew, discussing how the agency’s evolving interpretation may affect employers navigating the PWFA, which requires certain workplace accommodations related to pregnancy, childbirth, or related medical conditions.
