$1,000,000 SETTLEMENT - Motor Vehicle Crash - Aggravation of Migraine Headaches
Our client, a 56-year-old woman, was an APRN when she was injured in a two-car crash. She had prior medical conditions that consisted of migraine headaches and a fusion surgery to her neck. Following the crash, x-rays showed that 3 screws in her neck from the prior surgery had fractured in the crash, however, these hardware fractures did not cause her any pain or need to be repaired. She claimed that her pre-existing migraines were worse after the crash. The defendant argued that she the property damage to the cars from the impact was minor, our client already had migraines for decades requiring prescription medications, and that she had COVID after the crash that made migraines worse. We claimed that the fractured hardware was evidence that the impact was significant enough to break the hardware and therefore, it could also cause an injury to her brain. We also argued that the medical records before the crash showed she was managing her migraines well with medications, but after the crash she required botox injections. We also claimed she had to switch jobs eventually to another position where she earned about $15,000 less per year. We had experts in orthopedics, neurology, and an economist to lay out our client’s damages from the crash. We also worked with a medical illustrator to show the fractured hardware, which was an important piece of evidence to demonstrate the nature of the impact and likelihood of a resulting injury to her brain.
