Partner Albert DeNapoli was featured in a recent article published by Massachusetts Lawyers Weekly discussing a Massachusetts Appeals Court decision involving a long-running dispute between a mother and son over their family-owned auto body business.

In Powell v. Powell, the court upheld a $500,000 buyout option for the son and affirmed an order requiring his mother to bear the costs of relocating the business from her property. The decision also affirmed findings supporting the son’s promissory estoppel claim based on his mother’s decades-old promises regarding the business.

Representing the son, successfully both in the jury waived week long trial and before the Appeals Court, Al noted the significant impact that relocating a long-established business could have, emphasizing that the costs should not be borne by the shareholder who neither sought the move nor harmed the business.
