Sarah Westby was quoted in Law360's Employment Authority article entitled "Oregon Labor Peace Decision Gives 'Road Map' for Challenges." Sarah commented on an Oregon federal judge's recent decision to block a state law requiring employers in the cannabis industry to reach labor peace agreements with unions. The decision could bolster challenges to similar laws in other states as the issue continues on a path experts expect to land at the U.S. Supreme Court.
Sarah Westby, a partner at Shipman & Goodwin LLP who represents employers in the cannabis industry, said while labor peace agreement requirements vary by state, the Oregon ruling could help challenges to other laws because it discussed issues common to most provisions and gave in-depth analysis of the preemption question.
"I think this is a good road map for other employers who want to challenge these types of LPA requirements to make some of these more persuasive arguments about preemption," said Westby, who is chair of the firm's cannabis team.
