Secured an appellate victory on behalf of our client, Groton Long Point Association, Inc. (GLPA). GLPA is the record owner of rights of way that border properties owned by the plaintiffs, who are GLPA members. The plaintiffs sued GLPA claiming that they had acquired title to those rights-of-way by adverse possession or as prescriptive easements. GLPA defeated the plaintiffs' claims on summary judgment in the trial court and the plaintiffs appealed. The CT Appellate Court affirmed the trial court's summary judgment decision in favor of GLPA. In its decision, the Appellate Court found that the plaintiffs never had exclusive access to the rights-of-way, they did not adequately support their adverse possession claims with requisite evidence, and the deeds to plaintiffs’ properties were clear that the rights-of-way served merely as a boundary and were not deeded to the plaintiffs.
