Less than two weeks away until I join my ABA Section of Labor and Employment Law friends at the Employment Rights and Responsibilities Midwinter Meeting in Nashville.

There are so many great programs planned, but I’m looking forward to a panel I’m on regarding “Bostock, Executive Orders and the Evolving Framework for Gender Identity Discrimination”.

Besides me, our distinguished panel includes former EEOC General Counsel Karla Gilbride (now with Public Justice, Sandra Pullman, from the NY State AG’s office, and Tess Shelton at Godwin, Morris, Laurenzi & Bloomfield. Nicole Groves Bridgeforth from Meta will moderate.

This program will look at the current state of employment law regarding gender identity discrimination following significant policy shifts in 2025.

While the Supreme Court’s landmark Bostock decision established that Title VII prohibits employment discrimination based on sexual orientation and gender identity, recent executive orders have announced that the federal government will recognize only two sexes—male and female.

We will look at how the EEOC’s rescission of its Enforcement Guidance on Harassment in the Workplace affects workplace protections and employer obligations in this area. And we’ll look at what states are doing as a result too.
