Gregory P. Muccilli is a partner in the firm’s Real Estate, Environmental and Land Use practice group and serves as chair of the firm’s Pro Bono Committee.

Greg provides strategic guidance to a broad range of clients with respect to real estate development, commercial financing and commercial leasing matters throughout Connecticut and the broader New York and New England regions and in all commercial real estate asset classes.  His experience includes counseling clients in the acquisition, financing, development, leasing and disposition of industrial, commercial, mixed-use and multi-family residential properties.  Greg’s national leasing practice includes office, biotech/laboratory, retail and industrial leasing matters, having negotiated build-to-suit, reverse build-to-suit, sale-leaseback, ground lease and other forms of land development agreements on behalf of real estate owners, landlords and tenants.

Greg’s clients include some of New England’s largest real estate developers, publicly traded home builders, REITs, family offices, biotech companies, corporations, banks, commercial lenders, high-net-worth individuals, and governmental and quasi-governmental entities. He also serves as Connecticut counsel to companies and developers in multistate transactions which include real estate, and advises hotel owners and purchasers in the acquisition and disposition of luxury, historic, boutique and franchised hotel properties.

As a long-time member of the Special Committee on Standards of Title of the Connecticut Bar Association, Greg possesses an extensive understanding of matters involving title to real estate, the Connecticut Marketable Record Title Act and the Connecticut Standards of Title, and has been asked to serve as an expert witness on litigation matters involving title to real estate.

Greg also has broad experience appearing before the various land use agencies, boards and commissions of the City of New Haven.

Financing

New Markets Tax Credit Financing for Federally Qualified Health Center

Represented Federally Qualified Health Center in the leasing and financing of real property in downtown Winsted, Connecticut, through a New Markets Tax Credit structure, providing necessary funds to construct a health center and related facilities through a phased-in up to 39% tax credit with respect to an equity investment made. This financing will enable the client to expand and meet the growing need of the medically-underserved living in the area so that they may have access to quality, affordable and comprehensive primary and preventive health services, through the opening of this new health center.

Land use approvals and litigation

Acquisition and Land Use Approvals for Federally Qualified Health Center

Represented Federally Qualified Health Center in the acquisition and development of real property in downtown Winsted, Connecticut, enabling the client to expand and meet the growing need of the medically-underserved living in the area so that they may have access to quality, affordable and comprehensive primary and preventive health services. The Center will serve a racially and economically diverse population, many of whom have limited employment, transportation, housing and financial resources by adding additional exam rooms, providers, support staff, and equipment in a convenient location, dramatically reducing the number of adults who have no care, or have delayed or not sought care. Over the course of eighteen months, our team handled the negotiation of the purchase transaction, related land use approvals including the successful appeal of a denial by the local planning and zoning commission, as well as related historic, regulatory and environmental matters, allowing for closing of the transaction in early 2018.

Represented Toll Brothers, Inc. in Acquisition of Property for Large Mixed Use Developments in Stamford and Norwalk

Represented this leading national developer in the acquisition of four parcels along Summer Street, Bedford Street and North Street in Stamford, Connecticut, which will be developed into a new, seven-story, mixed-use development with ground-floor retail, parking garage and several-hundred apartments with related amenity space. Our team assisted with several aspects of the transaction, including reviewing and confirming land use approvals, examining and advising on title matters, advising on environmental matters, and preparing and negotiating closing documents and agreements.

Acquisition of Portfolio of Residential Apartment Buildings in New Haven and Related Financing

Represented a Connecticut developer in the successful acquisition and financing of dozens of residential apartments located in multiple historic buildings on Whitney Avenue in New Haven.

Approvals for Transit-Oriented, Mixed-Use, Historic Preservation Development in New Haven

Represented a Connecticut developer in the renovation and historic preservation of the John E. English Building in New Haven, converting the existing building into a mixed-use, transit-oriented development consisting of thirty-eight (38) apartments and related street-level commercial space. This development will serve to increase residential presence along State Street, and residents will enjoy convenient walking access to all downtown amenities as well as Yale University.

LIHTC Financing of Affordable Housing Development in New Haven

Represented a large regional developer with respect to a series of transactions which will result in the rehabilitation and renovation of the former Welch Annex School in New Haven into 30 apartments providing 100% deed-restricted affordable housing as part of New Haven’s Hill-to-Downtown Project. The transactions involved simultaneously closing on the acquisition of the property, 4% low-income housing tax credit financing from the Connecticut Housing Finance Authority, Housing Trust Fund financing from the Connecticut Department of Housing, CDBG financing from the City of New Haven and an unsecured loan from a related party, while entering into a joint venture agreement with a tax credit investor. In addition, our team prepared and negotiated the construction contract and various subcontracts, efficiently navigating the myriad requirements of the various governmental agencies involved.

Land Use Approvals for 96-Unit Mixed Use, New Haven Transit-Oriented Development

Represented a large New Haven developer in receiving site plan approval from the City Plan Commission of the City of New Haven to develop a new, ground-up mixed-use, transit-oriented development a block and a half off of the New Haven Green consisting of 96 apartments with related amenity space, rooftop deck with trellis, street-level commercial space and underground parking garage, all within convenient walking distance of the State Street Station and downtown New Haven.
