Construction and Real Estate Litigation

When faced with a complex construction or real estate dispute, you need a lawyer that is experienced in the realities (the "how to") of construction projects and real estate matters, one who understands and is familiar with the important party dynamics, documents and laws that govern such relationships. You also need an advocate experienced in the increasingly important arena of alternative dispute resolution, especially mediation and arbitration. Members of Shipman & Goodwin's Construction and Real Estate Litigation practice have that experience.

Our construction litigation practice represents owners, developers, sureties, architects, construction managers, contractors and trades in a wide array of construction disputes, from routine mechanic's liens to complicated, multi-party lawsuits. We regularly counsel clients from the very beginning of their construction projects, including the drafting of AIA and other contracts and negotiations over project documents, continuing throughout the project with an eye towards identifying and resolving issues before they become contested. When legal proceedings are necessary, our attorneys have extensive experience in all dispute resolution forums, including state and federal courts, arbitration and mediation.

Our real estate litigation practice represents commercial and residential clients in a full spectrum of property disputes, including lease disputes, boundary and trespass claims, evictions and summary process, tax appeals, condominium disputes and title insurance defense. We also have represented litigants in disputes over easements, adverse possession claims, foreclosures, appeals from condemnation and actions to quiet title, and many other matters involving real estate and property rights that end up in litigation or alternative dispute resolution. Our attorneys are well versed in the laws governing these types of claims and have extensive experience litigating in housing court and other state and federal courts.
