On March 1, 2026, Connecticut officially sunset the Transfer Act, replacing it with a new regulatory framework known as the Release-Based Cleanup Regulations (RBCRs).

According to Shipman partner Brendan Schain, the new release-based system, which he helped develop while serving as Legal Director at the Connecticut Department of Energy & Environmental Protection, is expected to help unlock redevelopment opportunities by encouraging cleanup work at properties that have remained vacant or underutilized for years under the Transfer Act framework.
