DHS Terminates Temporary Protected Status for Haiti

On July 1, 2025, the Department of Homeland Security (DHS) issued a notice of termination of Temporary Protected Status (TPS) for Haiti, effective September 2, 2025. After September 2, 2025, those individuals who have been granted TPS under Haiti's designation will no longer have TPS or accompanying work authorization. The DHS Secretary has automatically extended the validity of Employment Authorization Documents (EADs) for TPS beneficiaries under Haiti's designation through September 2, 2025. As proof of continued employment authorization through September 2, 2025, such individuals can show an EAD that has the category notation A12 or C19 and a “Card Expires” date of February 3, 2026, August 3, 2025, August 3, 2024, June 30, 2024, February 3, 2023, December 31, 2022, October 4, 2021, January 4, 2021, January 2, 2020, July 22, 2019, January 22, 2018, or July 22, 2017. After September 2, 2025, employers will need to reverify any employees whose work authorization will expire pursuant to this notice.
TPS is a temporary immigration benefit in the U.S. for individuals from certain countries that are experiencing conditions that prevent safe return (or where the country is unable to adequately handle the return of its citizens/residents). Conditions that would render a country and its citizens/residents eligible for TPS include ongoing armed conflict, environmental disaster, or other temporary conditions. Haiti was originally designated for TPS in January 2010, but DHS has determined that conditions in Haiti no longer support its ongoing designation for TPS.
