Federal Court Temporarily Stays Termination of Temporary Protected Status for Haiti

The United States District Court for the District of Columbia issued an order on February 2, 2026 that temporarily stays the effective date of the termination of the designation of Haiti for Temporary Protected Status (TPS), pending further judicial review. This includes accompanying work authorization for impacted individuals. Prior to this ruling, Haiti’s TPS designation (and accompanying work authorization benefits) had been set to terminate on February 3, 2026.
Employers with impacted employees can continue employing such individuals, pending further action by the courts and/or the U.S. Department of Homeland Security.
