Tracy Ellis Williams represents national and regional companies in commercial litigation and arbitration matters. She regularly represents clients in the state and federal courts of Connecticut and New York and before self-regulatory organizations. She also advises creditor-clients in all aspects of debt restructuring and loan workouts.

Tracy handles a wide array of commercial litigation matters, including contract disputes, business torts such as breach of fiduciary duty claims based on usurpation of corporate opportunities and diversion of corporate assets, fraud, negligence, unfair trade practices and unfair competition, as well as matters involving employment discrimination, securities, intellectual property, product liability including mass tort, insurance coverage, health care, legal malpractice defense, and insurance disputes.

In the area of commercial foreclosure litigation, Tracy represents financial institutions and loan servicers in all aspects of commercial litigation relating to contested mortgage foreclosures, and other litigation involving secured and unsecured lending, including the defense of lender liability claims. Tracy also represents clients in bankruptcy-related litigation matters, including adversary proceedings, lift stay motions, and the prosecution of claims in bankruptcy cases.

Resolved Breach of Contract Disputes 

For many years, we have represented a technological research and consulting firm in seeking to resolve disputes with its customers when those customers breached their contracts with our client, and/or claim that our client breached. Our client’s contracts contain an arbitration provision, and while we endeavour to reach non-litigated resolutions, we regularly represent them in arbitration proceedings. Over the last several years, we have prevailed in nearly every arbitration proceeding, and our awards have been affirmed by the applicable state courts.
